BEFORE HONOURABLE MR. JUSTICE KARDAK ETE ORDER Date : 22.05.2026 Heard Mr. A. Bhattacharjee, learned counsel for the petitioner. Also heard Mr. G. Ete, learned Additional Senior Government Advocate for the State. 2. The grievance of the petitioner is with regard to the payment of full pay and allowances for the period from 06.11.1993 to 17.11.2019 and fixation of his pay and allowances upon reinstatement in service by granting the benefits of increments, pay revision, ACP and MACP, etc. for the aforesaid period, along with all other consequential benefits. 3. Having considered the grievance of the petitioner, this Court, by an order dated 18.12.2024, directed the respondent authorities to re-compute the pay of the petitioner for the period with effect from 01.10.1993 till the date of his superannuation and by including the increments available to him during the period when he had remained under suspension and had remained out of duty on account of imposition of penalty of dismissal and to re-fix his pay. The
Page No.# 3/4 benefits under the ACP/MACP scheme, as would be entitled to be received by the petitioner be also reckoned while fixing his pay. 4.
Pursuant thereto, the respondent authorities filed an additional affidavit bringing on record the following facts, which is reproduced hereinunder:
“ The Service Book of the incumbent has been forwarded to the Superintendent of Police, Bomdila West Kameng District for Re-fixation of his pay for the period from 01/10/1993 to till date of his release from the establishment of SP Bomdila vide this office No. SP/LDV/PF/MR/2020/30-31 dated 07/01/2025. In response to this office letter No. referred above, the SP Bomdila has re-fixed the pay and allowances in respect of Shri Marli Rina, Ex-Constable, by granting periodical increments, ACP and MACP as admissible for the period from 01/10/1993 to 05/02/2020 and returned the service book to this office. On receipt of Service Book and pay fixation order from the SP Bomdila, this office has re-fixed his pay for the period from 01/07/2020 to 31/08/2022 (till date of his retirement) vide this office order No. SP/LDV/ESTT/PF/CT/MR/2024-25 dated 05/02/2025. Consequent upon granting his periodical increment w.e.f 01/07/2020 to 31/08/2022, this office has paid a sum of Rs. 9,17,508/- (Rupees Nine Lakhs Seventeen Thousand Five Hundred Eight) only vide bill No. 295 dated 07/02/2025 and the amount was deposited his Bank Account No. No. 11320415932 as arrear increment for the above period. Further the following revised pensionary benefits have been sanctioned and paid to Shri Marli Rina Ex-Constable from this office. (a) A sum of Rs. 6,26,174/- (Rupees Six Lakhs Twenty Six Thousand One Hundred Seventy Four) only sanctioned as Revised provisional retirement
Page No.# 4/4 gratuity vide Sanction order No. 19/25 dated 07/02/2025. This amount will be paid by the Director of Audit and Pension, Govt. of Arunachal Pradesh, Naharlagun at the time of finalizing his pension case is annexed herewith and marked as Annexure-H. (b) A Sum of Rs. 1,94,650/- (Rupees One Lakh Ninety Four Thousand Six Hundred Fifty) only sanctioned vide Sanction Order No. 20/25 dated 07/02/2025 and the said amount was deposited in his SB Account No. 11320415932 as Revised Leave encashment. On completion of all proceedings under this establishment, the Service Sheet along with all mandatory forms for reopening his pension case have been forwarded to the District of Audit and Pension, Govt.
of Arunachal Pradesh, Naharlagun vide letter No. SP/LDV/ESTT/PEN/CT/MR/2025/ 731-32 dated 12/02/2025 and at present the matter is under process under the Director of Audit and Pension, Naharlagun.”

Having perused above, and as agreed to by the learned counsel for the parties, I am of the view that the grievance of the petitioner has been duly redressed; thus, nothing remains to be adjudicated in the present proceeding. 6.
