JUSTICE MRIDUL KUMAR KALITA ORDER Date : 23.03.2026 1. Heard Mr. R. Goswami, the learned counsel for the appellant. Also heard Mr. R. Baruah, the learned counsel for the respondent Nos. 1 and 2- claimant. 2. It is submitted that the respondent No.3 has already expired. Page No.# 3/4 3. The learned counsel for the appellant as well as Mr. R. Baruah, the learned counsel for the respondent Nos. 1 and 2-claimant have submitted that this appeal was listed before Lok Adalat on 14th March 2026 and though, the matter was amicably settled between the parties. However, due to the absence of Respondent No.2, the matter could not be disposed of in the Lok Adalat. 4. The learned counsel for the appellant has submitted that matter has been amicably settled between the claimants and the Insurance Company and it has been agreed that the Insurance Company shall pay a total compensation amount of Rs. 28,26,740/- to the claimants out of which Rs.11,26,740/- has already been received by the claimants. Hence, he submits that the Insurance Company shall now have to pay the remaining amount of Rs. 17,00,000/- to the claimants. 5. Mr. R. Baruah, the learned counsel for the respondent Nos. 1 and 2- claimant agreed to the submissions made by the learned counsel for the appellant and has submitted that the appeal may be disposed of in terms of settlement arrived at between the parties. 6. Accordingly, after considering the submissions made by the learned counsel for both sides, this appeal is disposed of in terms of settlement arrived at between the parties. 7. The Appellant-Insurance Company shall pay a total compensation amount of Rs. 28,26,740/- to the claimant's respondents. Since an amount of Rs. 11,26,740/- has already been paid by the Insurance Company, it shall now pay the remaining amount of Rs. 17,00,000/- to the claimants. 8. The Insurance Company shall deposit the said amount before the Page No.# 4/4 Registry of this Court within a period of six weeks from the date of this order. 9. On such deposit, the Registry shall disburse the same to the claimant No.1 and 2 after proper verification. 10. Since an affidavit has been filed by Respondent No. 2 claimant, that the compensation due to him may also be received by Respondent No. 1, claimant who is his mother, hence, the Registry may disburse the entire amount of Rs. 17,00,000/- to Respondent No.1, Smt. Minakshi Baruah, after proper verification. 11. The Registry shall also return back the statutory deposit made by the appellant to the appellant after proper verification. 12.
