1. Heard the Learned counsel for the petitioner as well as the Learned counsel for the respondents.
2. The Writ petition is filed to direct the concerned respondent authority to conduct an independent enquiry with respect to the distribution of food grains to the consumers of Panchayat Bardi Khurd, village- Bardikala, P.S.- Barun, District- Aurangabad, Bihar, by the PDS
Patna High Court CWJC No.18287 of 2022 dt.14-07-2026 2/3 dealer (Respondent No. 6), who is deliberately and willingly distributing lesser quantity of inferior food grains to the consumers.
3. It is the specific contention of the
Learned counsel for the petitioner that the petitioner is one of the consumers of the PDS shop of Respondent No. 6 and has grievance regarding the distribution of lesser quantity of food grains to the consumers. He further submits that the petitioner made an application before the District Supply Officer; however, despite the said representation, no action has been taken. Therefore, the petitioner was constrained to file the present Writ petition.
4. It is noticed that there is no impugned
order in the present case. The concerned authority for receiving complaints against any PDS Dealer and taking appropriate action is the District Magistrate. Therefore, without going into merit of the case, this Court directs the petitioner to file an appropriate application before the District Magistrate within a period of one month from the
Patna High Court CWJC No.18287 of 2022 dt.14-07-2026 3/3 date of receipt of this order. In turn, the District Magistrate shall conduct a proper enquiry and, after hearing the petitioner, shall pass an appropriate order within a period of three months from the date of filing of the application.
5. With the above said observation, the Writ petition is disposed of.
6. Interlocutory Application(s), if any, shall stand disposed of.
