JUSTICE JITENDRA KUMAR ORAL ORDER 11 16-06-2026 This writ petition has been filed for quashing the F.I.R. bearing Ahiyapur P.S. Case No. 281 of 2021 dated 16.04.2021 registered for offence punishable under Sections 341, 342, 384, 323, 419, 420, 406, 467, 468 and 120(B) of the Patna High Court CR. WJC No.673 of 2022(11) dt.16-06-2026 2/3 Indian Penal Code. 2. However, learned counsel for the petitioners is seeking permission to withdraw the present writ petition because in this case closure report has been filed by the police qua the petitioners and as per further statement, the closure report has been even accepted by learned Judicial Magistrate. It also transpires at the bar that against the closure of the criminal case in pursuance of F.I.R. bearing Ahiyapur P.S. Case No. 281 of 2021 against the petitioners, informant has filed protest petition and the same is being treated by learned Judicial Magistrate as a complaint which is going on. 3. It further transpires that order of closing the criminal case against the petitioners in pursuance of the said F.I.R., the informant/victim has even preferred criminal revision bearing Criminal Revision No. 64 of 2026. 4. In view of the aforesaid facts and circumstances, the present petition has become infructuous. However, at this stage, learned counsel for the petitioners is seeking permission to withdraw the present petition with liberty to take legal remedy and contest the judicial proceeding going on in regard to the subject F.I.R.. 5.
