In compliance of Order dated 11th of August, 2026, Mr Rahul Yadav, Managing Director, Jammu & Kashmir Power Development Corporation, Srinagar is present in person. 02. Vide Order dated 17th of May, 2022, the Petition filed by the Petitioner herein came to be disposed of with a direction to the Respondents to consider the case of the Petitioner for payment of charge allowance in terms of Article 85 read with Article 87 of the CSR for the period the Petitioner had performed the duties of higher office, as were assigned to him from time to time. The Respondents were also directed to consider the Petitioner for promotion to the post of Junior Assistant as and when the posts of Junior Assistant in the promotional quota become available. This was, however, kept subject to the eligibility and position of the Petitioner in the seniority of Class-IV employees of the Division/ Corporation, as the case may be. 03. It appears that the Respondents have considered the claim of the Petitioner for payment of charge allowance and in pursuance of Order No. 333-JK (PDC) of 2026 dated 7th of August, 2026, an amount to the tune of Rs. 2,23,546/- was released in his favour vide Authority No. 192 dated 7th of August, 2026, covering the period till the disposal of the Writ Petition. 04. It is further seen from the Compliance Report filed by the Respondents on 10th of August, 2026 that in terms of the aforesaid Order No. 333-JK (PDC) of 2026 dated 7th of August, 2026, while considering the second part of the Judgment relating to promotion of the Petitioner, the Respondents have observed that the Petitioner shall be considered for promotion to the post of Junior Assistant, subject to his eligibility under the applicable Rules, availability of vacancy, seniority, qualifying the prescribed type test and fulfilment of other conditions governing such promotion. 05. In view of above, as of now, nothing survives in the instant Contempt Petition for further adjudication, therefore, the proceedings are closed. However, in case, the grievance regarding promotion, as and when undertaken by the Respondents, still survives, the Petitioner shall be at liberty to revive the Contempt Petition. 06.
