p. 1 IN THE HIGH COURT OF ORISSA AT CUTTACK CRLMP No. 848 of 2022 Susila Tiwari …. Petitioner None -versus- 1. The State of Odisha 2. Sanjay Bansal …. Opp. Parties Mr. Amitabh Pradhan, Additional Standing Counsel CORAM: THE HON’BLE MISS JUSTICE SAVITRI RATHO ORDER Order No. 30.06.2026 (Through Hybrid Mode) 05. 1. This CRLMP has been filed for a direction to the learned trial Court to conclude the trial in connection with G.R. Case No. 2340 of 2019 arising out of Infocity P.S. Case No. 110 of 2019 which is pending in the Court of the learned S.D.J.M., Bhubaneswar, Khurda as expeditiously as possible within the stipulated time by this Court. 2. The matter is listed in the weekly list for the week commencing from 29.06.2026 till 03.07.2026. When the matter was called yesterday i.e. 29.06.2026 as no counsel appeared on behalf of the Petitioner, the matter was passed over for the day. When it is called today, no counsel appears on behalf of the Petitioner. 3. Initially CRLMC No. 1636 of 2021 was filed on 15.09.2021. Pursuant to order dated 04.05.2022 passed in CRLMC No. 1636 of 2021 no counsel appeared on behalf of the Petitioner, but this Court directed the Registry to register the CRLMC as CRLMP. p. 2 4. On 22.06.2022, learned counsel for the Petitioner had prayed for a short adjournment to remove the defects as pointed out by the Stamp Reporter. On 29.06.2022 and 14.07.2022, the matter was adjourned at the request of the learned counsel for the Petitioner. Thereafter, it is listed today. 5. In view of the prayer in the CRLMP and as no counsel appears on behalf of the Petitioner it can safely be presumed that nothing survives to be decided in the CRLMP as more than seven years have elapsed since Infocity P.S. Case No. 110 of 2019 was registered and almost five years since filing of CRLMC No. 1636 of 2021. 6. Hence, the CRLMP is dismissed. 7. But in case trial in G.R. Case No. 2340 of 2019 is still pending, it is open to the learned counsel to file an application within a period of two weeks for recall/modification of this order. 8. Urgent certified copy of this order be granted on proper application. (Savitri Ratho) Judge Sukanta Designation: Senior Stenographer
