The present application has been filed by the applicant/respondent/claimant seeking release of amount of compensation awarded by the Motor Accident Claims Tribunal-IV, Kangra at Dharamshala, Camp at Baijnath, HP.
Vide Award dated 11.03.2022, an amount of Rs.1,68,700/- along with simple interest @ 7.5% p.a. from the date of filing the petition till the date of deposit had been awarded in favour of the applicant/respondent/claimant.
No reply is intended to be filed on behalf of the non-applicant. Non-applicant has no objection, if in case the present application is allowed and the 30% of the total amount lying deposited in the Registry of this Court is ordered to be released in favour of the applicant.
Other than the aforesaid, for the reasons mentioned in the application, application is allowed and 30% of the total amount, lying deposited in the Registry of this Court is ordered to be released in favour of the present applicant along with the upto date interest accrued thereupon. The same be remitted in the bank account of the applicant, details whereof have been given in para 4 of the application, subject to proper verification of his identity. The release so made shall abide by the final outcome of the appeal, if in case the appellant succeeds, the amount shall be refunded along with interest accrued thereupon.
Application stands disposed of.
