JUSTICE KAUSHIK GOSWAMI ORDER 19.09.2024 None appears for the petitioner when the matter is called. Heard Mr. M. Sahewala, learned Standing Counsel, ASTC for respondent Nos. 2 & 4 and Ms. M.D. Borah, learned Standing Counsel, Transport Departmet for respondent No. 1. It appears that on 07.06.2024 and 02.09.2024 when the matter was last called also, there was no representation on behalf of the petitioner. In fact, on 02.09.2024, i.e., on the last occasion when the matter was listed, this Court has observed that if the petitioner remains unrepresented in the next Court date, the instant writ petition will be considered for disposal in view of the Letter dated 14.12.2021. Since today also, when the matter is called, there is no representation on behalf of the petitioner. This Court upon perusing the Letter dated 14.12.2021 apparent that the petitioner at Sl. No. 18 of the said communication appears to have been reinstated to the post of driver and as such, nothing appears to be survived in the present writ petition. In view of the consecutive non-appearance of the learned counsel appearing on behalf of the petitioner, the instant petition stands dismissed for Page No.# 3/3 non-prosecution.
