GP FOR REVENUE The Court made the following: 4 THE HONOURABLE SMT JUSTICE KIRANMAYEE MANDAVA WRIT PETITION NO:8458/2021 ORDER:- Heard Sri Suragani Krishna Vamsi, learned counsel for the petitioners, and learned Assistant Government Pleader for Revenue appearing for the respondents. 2. The present Writ Petition has been filed challenging the action of the respondents in removing the names of the petitioners from the final eligibility list of beneficiaries under the scheme “Navarathnalu-Pedalandiriki Illu” for allotment of house plots to the landless poor in Lingala Village, Vatsavayai Mandal, Krishna District. 3. The 4th respondent - Tahsildar filed counter affidavit stating that the villagers have raised objections to the grant of house site pattas in favour of the petitioners as some of the petitioners have their respective residential properties. It is further stated that an enquiry was conducted by the respondents regarding the eligibility of the persons to avail the benefit of the scheme. In the said enquiry, names of the petitioners’ were included in the list of beneficiaries. However, they were found to be ineligible as they already have house sites either in their names or in the names of their family members. Therefore, the names of the petitioners were deleted from the final list of beneficiaries. 4. Having regard to the above, this Court is of the view that no mandamus can be issued directing the respondents to grant house site pattas 5 in favour of the petitioners, as, such relief cannot be granted while exercising jurisdiction under Article 226 of the Constitution of India. 5. However, the petitioners are at liberty to make a representation to the authorities, seeking grant of house site pattas. 6. In view of the foregoing, the Writ Petition is dismissed. There shall be no order as to costs.
