2 Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an writ, order or direction, more particularly one in the nature of Writ of Mandamus declaring the action of the 5th respondent in issuing the impugned notice dated 08.11.2021 directing the contestants to the Kuppam Municipality to take his prior permission for electioneering as illegal, arbitrary, in violative of Articles 14 and 19 of the Constitution of India and consequently direct the respondents to allow the political functionaries viz., Sri N.Amarnath Reddy, Pulavarthi Mani Prasad @ Nani, Nimmala Rama Naidu, MLA and P.S.Muniratnam to take part in the election campaign by setting aside the same and to pass such other order or orders as this Hon'ble Court may deems fit just and proper in the circumstances of the case.
IA NO: 1 OF 2021 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents to allow the political functionaries viz., Sri N.Amarnath Reddy, Pulavarthi Mani Prasad @ Nani, Nimmala Rama Naidu, MLA and P.S.Muniratnam to take part in the election campaign pending disposal of the above writ petition and to pass such other order or orders as this Hon'ble Court may deems fit just and proper in the circumstances of the case. This Writ Petition is filed seeking the following relief:
“… may be pleased to issue a Writ, Order or direction, more particularly one in the nature of Writ of Mandamus, declaring the action of 5th respondent in issuing the impugned notice dated 08.11.2021 directing the contestants to the Kuppam Municipality to take his prior permission for electioneering as illegal, arbitrary, in violative of Articles 14 and 19 of the Constitution of India and consequently, direct the respondents to allow the political functionaries viz., Sri N.Amarnath Reddy, Sri Pulavarthi Mani Prasad @ Nani, Sri Nimmala Rama Naidu, MLA and Sri P.S.Muniratnam to take part in the election campaign by setting aside the same and to pass such other order …”

When the matter is taken up for hearing, learned counsel for the Writ Petitioners submits that the cause in the presnt Writ Petition does not survive for adjudication, rendering the Writ Petition infructuous. 3. Recording the said submission made by the learned counsel for the Writ Petitioners, this Writ Petition is dismissed as infructuous. There shall be no order as to costs of the Writ Petition. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. _______________________ __
