JUSTICE ANJAN MONI KALITA ORDER Date : 30.03.2026 1. Heard Mr. B. J. Mukherjee, learned counsel for the petitioner. Also heard Ms. B. Borah, learned counsel for the respondents No. 2, 3 & 4. None appeared for the respondent No. 1. 2. The petitioner has preferred this writ petition seeking inter alia a direction to the respondent authorities to make payment of an amount of Rs. 82,53,583/- (Eighty two lakhs fifty three thousand five hundred eighty three), which the petitioner has claimed to be admitted liability in respect of a contract work i.e. widening and strengthening of the road from the Angthihara to Bhowraguri Road. 3. An affidavit in the instant case has already been filed on behalf of the respondents No. 2, 3 & 4, wherein, at paragraph 4 and 5, the respondents have stated as follows : A. That the BTC Authority has already sanctioned and released an Page No.# 3/4 amount of Rs. 4, 00, 000/- (Rupees four lakhs) and Rs. 5, 00, 000/- (Rupees five lakhs) against the scheme namely “Widening & Strengthening of road from Angthihara to Bhowraguri Road (bhowraguri to South Musalmanpara Road) from Ch.0.00m to Ch.2350.00) under BTC for the year 2013-14” in the financial year 2025-26 in favour of the petitioner. B. The deponent further more states that the remaining balance of R. 73,53,583/- (Rupees seventy-three lakh fifty-three thousand five hundred eighty-three) only respectively under process for making payment to the instant petition herein. 4. The learned counsel appearing for the respondents No. 2, 3 & 4 has submitted that they have already released the aforesaid amount of R. 9,00,000/- (Rupees nine lakhs) to the petitioner and the remaining amount of Rs. 73,53,583/- (Rupees seventy-three lakh fifty-three thousand five hundred eighty-three) will be released soon. The learned counsel has further submitted that the payment of remaining amount is in active consideration and the amount will be sanctioned very soon. 5. In view of the aforesaid submissions, the learned counsel appearing for the Page No.# 4/4 petitioner has submitted that the instant petition can be disposed of with a direction to release the payment specifying a period for such payment, to which the learned counsel for the respondents No. 2, 3 & 4 have not objected to. 6. In view of the aforesaid, this Court is of the opinion that this petition can be disposed of with a direction as mentioned above. 7. In view of the aforesaid, it is directed to respondents No. 2, 3 & 4 to release the remaining payment of Rs. 73,53,583/- (Rupees seventy-three lakh fifty-three thousand five hundred eighty-three) to petitioner within a period of 3 (three) months from today i.e., 30.03.2026. 8. The learned counsel for petitioner will submit a certified copy of the instant order to the respondent authorities for the needful at the earliest. 9.
