1. Mr. Ganesh Kandpal, learned counsel for the petitioner.
2. Mr. Pradeep Hairiya, learned Standing Counsel for the State.
3. By the instant petition the petitioner is praying for the following relief: i.
“a writ order a direction in the nature of certiorari to call for the record of the case and quash the order dated 1.9.2020 contained in Annexure no. 8 to the writ petition. ii. a writ order a direction in the nature of mandamus directing the respondents to refund the amount recovered by them pursuant to the order dated 1.9.2020 from the retiremental dues of the petitioner. iii. A writ order a direction in the nature of mandamus directing the respondents to grant the retiremental dues as well as pension to the petitioner on the basis of pay scale Rs. 9300- 34800+grade pay of Rs. 4600/- granted to him as benefit of 3rd ACP.”

Learned counsel for the petitioner submits that he is not pressing the relief no. 3, however, in respect of the remaining reliefs he submits that the issue is squarely covered by the judgment of the Hon’ble Apex Court in the case of State of Punjab vs. Rafiq Masih SCC 2014 (8) 883.
5. Learned State counsel fairly submits that the issue is covered by the aforesaid judgment.
6. In view of this, the instant writ petition is
disposed of in terms of the judgment of Hon’ble Apex Court in the case of State of Punjab vs. Rafiq Masih SCC 2014 (8) 883 and the respondents are directed to refund the amount as recovered from the petitioner within a month.
