The present Special Leave to Appeal has been filed under Section 378(4) of the Criminal Procedure Code, praying for grant of special leave to challenge the judgment and order dated 31.03.2021 passed by the learned Judicial Magistrate, IInd, Dehradun in Criminal Case No. 02 of 2015 under Section 138 of the Negotiable Instruments Act, 1881.
5. After hearing learned counsel for the Appellant and upon perusal of the record, this Court finds sufficient grounds to grant leave. Accordingly, the Special Leave to Appeal is allowed and the Appeal is admitted.
6. The matter dates back to 29.07.2021, being the date of its inception. Trial Court Record has been received.
7. Let the paper book be prepared and supplied to learned counsel for the parties, as per Rules.
8. Objections, if any, be filed by the Respondents.
