Present special leave to appeal is filed by the appellant against the judgment and order dated 27.03.2021 passed by learned ACJM/10th Addl. Civil Judge (S.D.), Dehradun in Complaint Case No.4351 of 2016. 3. Heard on delay condonation application. 4. The main objection raised by learned counsel for the respondent is that despite having sufficient knowledge there is deliberate delay on part of the applicant as he was well aware of the procedure. 5. Whereas the cause of delay as shown by the appellant in the application and through oral submission is that the applicant was in the procedure as advised by the learned counsel, who was filing the same and this is the cause for delay. 6. After hearing the learned counsel for the parties, the delay of 111 days in filing this criminal appeal is well explained. Delay is condoned. Accordingly, delay condonation application is allowed. 7. Leave to appeal is granted. 8. Admit. 9. Let the objection be filed by the State within two weeks. 10.
