Present application is filed by the appellant under Section 372 and Section 378(4) of Cr.P.C. challenging the judgment and order dated 08.04.2021 passed by learned Special Judge (SC/ST) Rudraprayag passed in Special Session Trial No.01 of 2020 State vs. Bhagat Singh and others arising out of FIR No.03 of 2019, P.S. Rudraprayag, District Rudraprayag under Sections 147, 427, 452, 504, 506 & 149 of IPC and Section 3(1)(r), 3(1)(s) of Schedule Caste and Schedule Tribe (Prevention of Atrocities) amended Act 2014 whereby accused/respondent nos.2 to 7 have been acquitted under the aforesaid Sections. 5. After hearing learned counsel for the appellant, who at the outset submits that though there was sufficient evidence before the trial court in support of the charge of the offence under Sections 147, 427, 452, 504, 506 & 149 of IPC and Section 3(1)(r), 3(1)(s) of Schedule Caste and Schedule Tribe (Prevention of Atrocities), learned trial court did not appreciate the evidence that supported the incident. 6. Primafacie the grounds for allowing the special leave to appeal seems to be sufficient. Special leave to appeal is granted. 7. Admit. 8. Since there is representation on behalf of other respondents, notices need not be issued. 9. Learned counsel for the respondents prays for and is granted two weeks time to file counter affidavit. 10.
