After arguing for a while, learned counsel appearing on behalf of the petitioners, when confronted with the maintainability of the instant petition, seeks withdrawal of the instant petition with liberty to seek appropriate remedy under law before the competent Court, particularly in the light of the specific averments pleaded in Para 19, which for facility of reference is reproduced as under: “19. That, petitioner no.02 being injured in the said case being not satisfied with the investigation carried by the present investigating officer namely Chanchal Singh Inspector and thus sough rejection of the said final report before the Ld. Sub- Registrar, Jammu and directing the police to file fresh final report in accordance with the law or in the alternative requests the Hon'ble Court to take cognizance of the matter himself and proceed in accordance with law by recording the statement of the applicant/injured and issue process against the accused named in the FIR. Copy of the final report submitted before the Ld. Sub-Registrar, Jammu and the protest petition filed by the petitioner no.2 is annexed herewith and marked as Annexure-XI and XII.” S.
