After arguing for a while, when the learned counsel for the petitioners was confronted with the maintainability of the instant petition, with particular reference to the prayer part wherein the petitioner, in fact, has projected that he is aggrieved of the order passed by the learned Magistrate whereby a direction was issued to respondent No. 1- SHO, Mughal Madian to register FIR, without complying with the provisions of the Criminal Procedure Code which was in vogue at that relevant point of time, he seeks withdrawal of the instant petition. 2. In the aforesaid backdrop, learned counsel for the petitioners seeks withdrawal of the instant petition with a liberty to pursue the matter before the learned trial Court where the challan has already been filed. The petitioner will be permitted to take all factual and legal grounds before the learned trial Court where the challan is pending. Serial No. 19 2 CRM(M) No. 508/2021 3. In the light of the statement so made by the learned counsel for the petitioners, the instant petition is dismissed as withdrawn with a liberty as prayed for. 4.
