While arguing the matter, learned counsel for the petitioner has drawn the attention of this Court towards the earlier round of litigation initiated by the petitioner by way of writ petition bearing SWP No. 331/2018, which was disposed of vide order dated 17.04.2018, in which the respondents were directed to issue appointment order in favour of the petitioner within a period of six weeks from the date, copy of that order was to be made available to the respondents. 2. The respondents, instead of appointing the petitioner, issued order dated 09.01.2019, impugned in the instant petition, rejecting the claim of the petitioner by placing reliance upon Government order No. 919-Edu of 2018 dated 16.11.2018. 3. Learned counsel for the petitioner submits that the claim of the petitioner be considered in terms of judgment rendered by the Supreme Court in U. T. of J&K and others vs. Saba Wani and others. Mr. Anishwar Chatterji Koul, learned GA submits that the respondents 62 WP(C) No. 392/2021 Page 2 of 2 would have no objection, in considering the case of the petitioner in terms of judgment(supra). 4. In view of the above, the present petition is disposed of with a direction to the respondents to consider the claim of the petitioner strictly in terms of the judgment of the Supreme Court referred above as well as order dated 17.04.2018(supra).
