1. This writ petition has been preferred by the petitioners under Article 226 of the Constitution of India, seeking following reliefs:-
“10.1 That, this Hon’ble Court may kindly be pleased to direct the respondent to consider and grant appropriate risk cover amount of Rs.50,00,000/- as it is granted to the Health Worker, in the interest of justice. DEEPTI JHA Digitally signed by DEEPTI JHA
2 10.2 Any other relief which may be suitable in the
facts and circumstances of the case, may also be granted.”
2. Learned counsel for the petitioners submits that petitioners are the legal representatives of the employees of respondent No.2. While they were working as teachers, they have been deputed to discharge their other duties during the COVID-19 PANDEMIC. While discharging their duties, they got infected with COVID-19 Virus. Employees of the respondent No.2 died due to COVID-19 PANDEMIC disease. Thereafter, petitioners submitted representation through union before the authorities seeking compensation according to the policy formulated by the Government. As per policy, the persons engaged in the COVID-19 PANDEMIC duty, if died due to COVID-19 PANDEMIC, family members of those are to be given compensation, however, no such compensation have been given to the petitioners.
3. Learned State counsel submits that reply has not been filed and prays for time. He further submits that petitioners have straight away approach before this Court by filing of this writ petition, if petitioners submits representation before the respondent authorities, it can be considered in accordance with law.
4. I have heard learned counsel for the respective parties and perused the material available on record.
5. Considering the facts and circumstances of the case and nature of grievance of the petitioners, I find it appropriate to dispose this petition, permitting petitioners to submit representation before the authorities, to be considered and decided in accordance with law. Accordingly, this writ petition stands
disposed of, permitting petitioners to submit fresh representation before the respondents No.1 & 2 as well as before the concerned Collector and if, such a representation is submitted, the authorities concerned shall consider and
3 take decision on the representation filed by the petitioners expeditiously, preferably within a period of four months from the date of receipt of representation.
6. With the aforesaid direction, this writ petition stands disposed of.
7. Interlocutory application(s), if any, also stands disposed of. Sd/-
