1. This writ petition has been filed against the order dated 29.10.2020 & 31.10.2020 (Annexure P/1) by which ₹33,23,451/- has been sought to be recovered from the petitioner.
2. Mr. V.K. Pandey, learned counsel for the petitioner, would submit that vide Annexure P/7 dispute has been settled and amount to the tune of ₹15,46,748/- was directed to be paid, which has already been paid by the petitioner and all of sudden without affording opportunity of hearing to the petitioner recovery order ANKIT KUMAR SINGH Digitally signed by ANKIT KUMAR SINGH
2 WPC No. 91 of 2021 to the tune of ₹33,23,451/- (Annexure P/1) has been passed, therefore, Annexure P/1 is liable to be set aside.
3. Mr. Rahul Tamaskar, learned State counsel, would oppose the prayer made by learned counsel for the petitioner and support the impugned order.
4. I have heard learned counsel for the parties, considered their rival
submissions made herein above and gone through the records with utmost circumspection.

A careful perusal of Annexure P/7 would show that pursuant to orders of recovery dated 20.02.2020, 19.05.2020 and 16.06.2020 and (Annexure P/7) ₹15,46,748/- has already been deposited by the petitioner herein. Thereafter, order of recovery to the tune of ₹₹33,23,451/- has been passed vide Annexure P/1 without affording opportunity of hearing to the petitioner which is in the teeth of principle of natural justice. In that view of the matter, impugned order (Annexure P/1) is liable to be and is hereby quashed. However, the concerned respondent is at liberty to pass fresh order after affording opportunity to the petitioner.
6. With the aforesaid observation/direction, the instant writ petition stands disposed off.
