Counsel for the petitioner submits that, pursuant to the order dated 21.12.2023, notices have been issued to the respondents. Though the order is dated 21.12.2023, notices were issued after condoning the delay in payment of the process fee on 29.01.2026. When the case was listed on 13.04.2026, this Court recorded that there was no representation on behalf of the respondents despite service of notice and also recorded the submission made by the counsel for the 2 petitioner that the subject matter of the contempt petition is under challenge in the writ appeal by SECL bearing WA No. 433 of 2021, which has also been dismissed, against which SECL has filed an SLP which is pending consideration. When this Court posed a question to the counsel for the petitioner about the status of the SLP, learned counsel fairly submitted that he verified the status on the website of the Hon’ble Supreme Court and, according to the information available, a stay has been granted in favour of the department. 2. Considering the aforementioned facts and circumstances of the case, more particularly that the order subject matter of this contempt petition passed in WPS No. 1305 of 2008 is pending consideration before the Hon’ble Supreme Court and further that there is an interim order of stay, as submitted by the counsel for the petitioner, I am of the view that no purpose would be served in keeping this contempt petition pending. 3.
