In the present case, there is a dispute with regard to the surname of the Government servant, whose name is mentioned as ‘Shrawan Kumar Sahu’ in the service record, whereas the Succession Certificate has been issued for collection of the retiral dues of ‘Shrawan Kumar Kshatriya’; therefore, the respondent authorities have not disbursed the terminal benefits to the petitioner, who is the son of the Government servant, and it would be apt for the petitioner to approach the competent Civil Court to obtain a declaration in this regard. 2. At this stage, Mr. Mishra, learned counsel for the petitioner would seek permission of this Court to withdraw the writ petition with liberty to file a duly constituted civil suit before the competent Civil Court and obtain a decree of declaration. 3. No objection from the other side. 4. Permission granted. 5. Accordingly, the writ petition is dismissed as withdrawn with the liberty as prayed for. 6.
