This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the respondents to sanction the petitioner's retirement benefits, namely, regular pension, DCRG, commutation, encashment of 240 days of earned leave, 90 days of unearned leave and Special Provident Fund, along with accrued interest, by considering the representation of the petitioner, dated 24.07.2019, within a time frame to be fixed by this Court. 2.The learned counsel appearing for the petitioner submitted that the petitioner, who had retired from service, is entitled to the aforesaid retirement benefits. However, despite submitting a representation dated 2/6 https://www.mhc.tn.gov.in/judis W.P(MD)No.15294 of 2021 24.07.2019, the same has not been considered and the retirement benefits have not been settled so far. 3.The learned counsel for the petitioner further submitted that the petitioner would be satisfied if this Court issues a direction to the competent authority to consider the petitioner's representation, dated 24.07.2019, and pass appropriate orders thereon within a time frame to be fixed by this Court. 4.The learned counsel appearing for the respondents submitted that the representation of the petitioner would be considered and disposed of by the respondents in accordance with law within a time frame to be fixed by this Court. 5.In view of the above, this Court, without going into the merits of the claim made by the petitioner, directs the authority concerned to consider the representation of the petitioner, dated 24.07.2019, and pass 3/6 https://www.mhc.tn.gov.in/judis W.P(MD)No.15294 of 2021 appropriate orders thereon, on merits and in accordance with law, after affording an opportunity of hearing to the petitioner, and settle the terminal benefits, if the petitioner is otherwise eligible. Such exercise shall be completed within a period of six weeks from the date of receipt of a copy of this order. 6.The Writ Petition is disposed of with the above direction. There shall be no order as to costs.
