2. The petitioner herein is the husband and the respondent is his wife. The respondent/wife filed a petition seeking maintenance in M.C. No.3 of 2018 before the Family Court, Trichy. The said petition was allowed by the learned Family Court. Aggrieved by the said order, the present Criminal Revision Case has been filed. 3. The learned counsel for the petitioner submitted that the marriage between the petitioner and the respondent is not disputed. However, the income of the petitioner is only Rs.11,259/- per month and he has to maintain himself as well as his mother, who is a senior citizen. Therefore, awarding a sum of Rs.5,000/- (Rupees Five Thousand only) per month as maintenance to the respondent/wife is excessive and beyond his means. The learned counsel further submitted that the amount remaining after payment of the said maintenance would not be sufficient for the petitioner to maintain himself and his mother. 4. Proper notice has been served on the respondent and her name has also been printed in the cause list. However, neither the respondent nor any counsel on her behalf appeared before this Court for hearing when the matter was called. 5. Heard the learned counsel appearing for the petitioner and carefully perused the materials available on record. 6. The Family Court has recorded that since 2011, the petitioner/husband has been working at P.L.A. Rathina Residency, Trichy, for a monthly salary of Rs.8,000/- (Rupees Eight Thousand only). However, he failed to produce any documentary evidence to substantiate his claim regarding the said income. 7. A careful perusal of the materials available on record would reveal that the respondent/wife examined herself as P.W.1 and the petitioner/husband was examined as R.W.1. However, on the side of the respondent/wife, four documents were marked, whereas no documents were marked on the side of the petitioner/husband. 3/6 https://www.mhc.tn.gov.in/judis

This Court does not find any infirmity in the order passed by the Family Court, wherein it was held that the petitioner/husband had miserably failed to prove that his income was only Rs.8,000/- (Rupees Eight Thousand only). However, during the course of arguments before this Court, the learned counsel for the petitioner produced a salary slip of the petitioner. 9. A careful perusal of the salary slip produced before this Court does not throw any light on the genuineness of the same. Since no salary slip was marked before the trial Court, this Court does not find any infirmity in the order passed by the Family Court, Trichy, awarding maintenance of Rs.5,000/- per month to the respondent/wife. The said amount of Rs.5,000/- is only a meagre sum, with which the respondent/wife cannot maintain herself.
