Today, when the matter is called for hearing, the learned counsel for the appellant represented that the first respondent took possession of the disputed land and hence nothing survives in this appeal. 2 The appellant is the plaintiff and he filed the suit for declaration and permanent injunction. Pending the suit, the first respondent herein, who is the fourth defendant in the suit, had filed an application in A.No.1915 of 2020 under Order 7 Rule 11 CPC seeking rejection of plaint. The learned Single Judge, vide order dated 18.12.2020, allowed the application and rejected the plaint. 3 Aggrieved over the said order of rejection of plaint, the plaintiff has filed the present appeal.
