2. This writ appeal is directed against the order dated 25.02.2021 made in W.P.(MD)No.5144 of 2016 filed by the appellant herein. The appellant herein questioned the appointment of the sixth respondent Senthamarai as Noon Meal Organizer in Panchayat Union Primary School, Kumbakudi. WA(MD) No. 637 of 2021 __________ Page3 of 6 When the matter was taken up for hearing in the year 2021, copy of the appointment order was produced. According to the appellant’s counsel, they made a request for adjournment on the ground that they need to amend the writ prayer by formally challenging the appointment. However, according to him, their request was erroneously recorded as if the writ petitioner’s counsel sought liberty to file a fresh writ petition. The order dated 25.02.2021 disposing of the writ petition reads as follows:-
“ 4. The learned counsel appearing for the petitioner seeks liberty to file a fresh writ petition, challenging the appointment order issued in favour of the sixth respondent. …
6. Considering the limited request made by the
learned counsel for the petitioner, this Court, without expressing any opinion on the merits of the matter, grants liberty to the petitioner to file a fresh writ petition, challenging the order of appointment issued in favour of the sixth respondent.”
3. When this order obviously reads like a consent order, this writ appeal is technically not maintainable. It is for the writ petitioner to move the very same learned Judge who fortunately is sitting in the Madurai Bench as of now for recall.
