1. By way of this petition, the petitioner has sought the following relief(s):-

2 respondent no. 2 to include the name of petitioner at serial no. 126 in the eligibility list (above the name of Manoj Singh which is at serial no. 127), in the interest of justice. 10.3 That any other relief, which this Hon'ble Court may deem fit and proper together with cost of the petition.”

Learned counsel for the petitioner would submit that at the relevant time, the petitioner was holding post of Assistant Sub-Inspector under the respondents as he was promoted on the said post vide order dated 05.10.2011. He would contend that seniority list of Assistant Sub-Inspector was published in the year 2020, wherein, name of the petitioner was at serial No. 244, whereas, name of Mr. Manoj Singh was at serial No. 245. He would contend that list of eligible candidate for promotion to the post of Sub-Inspector was published by Director General of Police on 21.02.2021, wherein, name of the petitioner does not appear, whereas name of Mr. Manoj Singh appears at serial No. 127.
He would contend that as name of the petitioner appears above to Mr. Manoj Singh in seniority list of Assistant Sub-Inspector, his name should have been considered for promotion. He would contend that the respondent authorities have not assigned any reason for such discriminatory action. 3. On the other hand, Mr. Saini would submit that in ACR of year 2019 and 2020, the petitioner was awarded Grade “C”, and therefore, his name was not included in the list of eligible candidates for post of Sub-Inspector. He would contend that the petition deserves to be dismissed. 4. Heard. 5. Taking into consideration the limited grievance raised by the petitioner, this petition, at this juncture, is disposed of reserving liberty in favour of the
3 petitioner to make a detailed representation before respondent No. 2, and in turn, the said authority is directed to decide it within a period of 120 days in objective manner. 6. With the aforesaid observation(s), and direction(s), the instant petition is hereby disposed of. Sd/-
