1. This is a writ petition filed under Article 226 of the Constitution of India seeking the following reliefs :-
“A) Issue a writ of prohibition or any other appropriate writ, order or direction thereby prohibiting the respondents, their agents, servants, associates, successors, employees, officials, etc. from taking possession, removing electricity meters and building material and other belongings of the petitioner lying on the property or causing any damage to the property of the petitioner bearing no. T-1-3/228, P & T Block, West Sagarpur, New Deihi-46 as shown in red colour in Annexure P-1. B) Issue a writ in the nature of mandamus directing the respondents to; pay compensation of rupees ten lakhs for their illegal and unconstitutional demolition and destruction of the properties of the petitioner and further to restore back the property to the petitioner in its original condition at their own costs. C) Issue a writ, order or direction in the nature of writ of mandamus thereby directing the respondents to abide by the policy decision not to take action for further demolition in respect of the properties of the petitioner and not to interfere in the properties of the petitioner i.e. T-1-3/228, P T Block, West Sagarpur, New Delhi-46 as shown in red colour in Annexure P-1.”

the property bearing no. T-1-3/228 P&T Block, West Sagarpur, New Delhi-110046, and the boundaries of the plot of the petitioner are disputed as evident from the reply filed by the respondent to the contempt petition bearing CCP No. 284/2021,
3. In this view, Mr. Chaudhary, learned counsel for the petitioner, states that the issue of boundary wall will involve detailed evidence as there are disputed questions of facts. To prove the same he will have to lead evidence.
Therefore, he seeks to withdraw the petition with liberty to file a suit in accordance with law. 4. I am of the view that the petition is pending since 2012 and the petitioner is a bonafide litigant pursuing his legal remedy. In case the petitioner files the civil suit within 8 weeks from the date of uploading of this order, the petitioner shall be entitled to the benefit of the Section 14 of the Limitation Act, 1963. 5. The court has not opined on the merits or the demerits of the matter. 6. Further, the petitioner shall be entitled to benefit of section 14 for the period from the filing of the petition till today. 7. In view of the aforesaid, the petition is disposed of. 8. In view of the order passed in the writ petition, Mr. Chaudhary,
learned counsel for the petitioner does not press the contempt petition.
9. For the said reason, the contempt petition is also disposed of.
