1. The petitioners in the present petition have assailed the withdrawal
order dated 21.09.2020 passed by Northern Regional Committee (“NRC”) whereby the recognition granted to petitioner institute for B.Ed. Course with 100 seats (two basic units) was withdrawn. against the said order was also dismissed by the Appellate Committee vide impugned order dated 11.02.2021. The petitioners further assail subsequent withdrawal order dated 11.04.2022 passed by NRC and also subsequent appellate committee order dated 09.02.2023. 2. Mr. Kumar, learned counsel appearing on behalf of petitioner submits that withdrawal of recognition is essentially on the ground that petitioner is not meeting the requirement of requisite qualified faculty. He submits that petitioner was recognized for 100 seats and for the same, the college is required to have 16 faculty including Principal. 3. He fairly states that the petitioner institute, at present has only 10 faculty members including Principal. He submits that the petitioner at this stage is confining its prayer for restoration of 50 seats (one basic unit), since the requirement for 50 seats is only 8 faculty members, which is undisputedly being fulfilled by the petitioner institute. The aforesaid factual position is also not disputed by Mr. Rupal, learned counsel appearing on behalf of respondents. 4. In view of the above, the present petition is allowed. 5. Accordingly, impugned orders dated 21.09.2020 & 11.04.2022 passed by NRC and the orders dated 11.02.2021 & 09.02.2023 passed by the Appellate Committee are quashed. 6. Consequently, respondents are directed to restore the recognition of petitioner qua 50 seats (one basic unit) within a period of one week from today as the counselling is under process. The respondents are directed to communicate to the affiliating university, i.e., Raja Mahendra Pratap Singh State University as well as the State Government of Uttar Pradesh within the aforesaid period of one week. the status of petitioner as recognized institution for conducting B.Ed course with intake of 50 seats (one basic unit) on their official website within a period of one week. 7. Insofar as the remaining 50 seats (2nd basic unit) of B.Ed course of petitioner institution is concerned, the following directions are issued: (i) The respondents are directed to carry out fresh inspection in terms of Section 13 of the NCTE Act and inform the petitioner institute about recommendations/views, if any, on the basis of such inspection along with inspection report; (ii) In the event any deficiencies are pointed out in the recommendations, respondents shall grant reasonable time to the petitioner institute to rectify the same; and (iii) If no deficiencies are recommended, or in case deficiencies recommended by respondents are rectified by petitioner institute during the time period granted to it, respondents shall restore the recognition of petitioner institute for the remaining 50 seats (2nd basic unit) of B.Ed course and consequently, the respondents shall communicate about the restoration order to the affiliating university of the petitioner institution, as well as, to the State Government. Further, the respondents shall also do the needful with regard to updation of the status of petitioner institution in respect of the remaining 50 seats (2nd basic unit) of B.Ed course on its official website. 8.
