1. This is an application seeking impleadment of Master Arya Munjal as defendant no.4 and also seeking that the defendant no.2 be permitted to act as guardian of the said defendant. The application is not opposed. 2. Considering the averments made in the application, the same is allowed. 3. Accordingly, Master Arya Munjal is impleaded as defendant no.4 in CS(OS) 405/2021, through his natural guardian, defendant no.2. 4. By way of the present application, the plaintiff and the defendants jointly seek that the Memorandum Recording Oral Family Settlement (MOFS) dated 10.07.2026 executed between them be taken on record and a consent decree be passed in terms thereof. 7. It is averred in the MOFS that the said settlement was arrived at voluntarily, out of their own free will and without any coercion, undue influence or duress. 8. It is submitted that all outstanding disputes between the parties stand resolved in terms thereof. 9. It is further pointed out that the said agreement contemplates certain payments to be made over a period of time and certain mutual obligations to be performed, as set out therein. 10.
Respective counsel for the parties undertake, on instructions that the parties shall remain bound with, and adhere to the terms thereof. 11. Taking note of the aforesaid undertaking, and the joint request of respective counsel, the present suit is disposed of in terms of the Memorandum Recording Oral Family Settlement dated 10.07.2026. 12. The suit along with the pending applications stands disposed of in the above terms. CS(OS) 405/2021
