The present writ petition has been filed on behalf of six (6) clubs (hereinafter, ‘petitioner clubs’) seeking quashing of the circular dated 16th October, 2020 issued by the respondent, i.e., erstwhile South Delhi Municipal Corporation (presently, Municipal Corporation of Delhi). 2. A further relief sought in the writ petition was quashing of three (3) orders dated 29th October, 2020 and two (2) show cause notices dated 18th November, 2020 issued by the respondent/ MCD. 3. Mr. Kapil Dutta, counsel appearing on behalf of the respondent/ MCD, has handed over an affidavit in Court. The same is taken on record. 3.1 In terms of paragraph 7 of the said affidavit, a new policy was framed This is a digitally signed order. Mr. Kapil Dutta submits, on instructions, that the earlier show cause notices have been withdrawn. He further submits that pursuant to the new policy framed under the circular dated 4th November, 2022, no further action has been taken against the petitioner clubs till date. 5. In view thereof, the present writ petition is disposed of while giving liberty to the petitioner clubs to file appropriate proceedings in accordance with law in the event any fresh show cause notice is issued by the respondent/ MCD. 6. The costs imposed on the respondent/ MCD vide order dated 31st July, 2023 stand waived. 7. The pending application also stands disposed of.
