1. The present petition has been filed by the petitioner under Article 226 of the Constitution of India, seeking a writ of certiorari, for quashing the salary statements of the petitioner (Annexures P-4 and P- 5) pertaining to January, 2021 and February, 2021, wherein the respondents have started recovery of Rs.7,500/- per month from the salary of the petitioner since January, 2021 without any notice, order or enquiry in reference to recovery. Further, a writ of mandamus has been sought for directing the respondents to stop effecting recovery from the petitioner forthwith and to release the already recovered amount from the petitioner along with interest @ 12% per annum.
2. While issuing notice of motion on 06.04.2021, further VINAY 2026.09.03 17:07 I attest to the accuracy and authenticity of this
order/judgment
CWP-7662-2021 -2- recovery from the salary of the petitioner was stayed and the said interim order is still continuing.

Learned counsel for the petitioner submits that the basic pay of the petitioner has been reduced without passing any specific
order to that effect and without issuing any show cause notice to the petitioner, which is in violation of the principles of natural justice. He has placed reliance upon a judgment of this Court in Sarup Chand v. State of Punjab and others : 2024 NCPHHC 147824.
4. Learned Senior Counsel for the respondents could not refute the said contention of the learned counsel for the petitioner.

In this view of the matter, the present petition is partly allowed and the respondents are directed to reconsider the matter strictly in accordance with the principles of natural justice by issuing show cause notice; giving an opportunity of personal hearing to the petitioner, within a period of three months from the date of receipt of certified copy of this order.
