The Hon’ble Court vide order dated 17.03.2026 has, inter alia, directed as under :- “.... 34.There is no infirmity in the impugned Judgment and decree dated 20.02.2020 and the Appeal is hereby, dismissed along with pending Application. 35. Learned counsel for the Respondent submits that he has deposited Rs. 5,10,000/- dated 12.01.2024 by way of FDR. Since the Appeal has been dismissed, the amount be released to the Respondent/ Plaintiff.” 3. Upon perusal of the file, the background of this case is that the Hon’ble Court vide order dated 09.10.2023 had, inter alia, directed as under:- “2. Since there is a money decree in favour of the respondent and the money decree has been stayed, respondent is entitled to release of the said amount. 75% of the decretal amount lying deposited in this court pursuant to the order dated 05.04.2021 along with accrued interest is directed to be released in favour of the respondent’s nominee subject to furnishing of security to the satisfaction of the Registrar General.” 4. In compliance of the aforesaid order, the respondent/firm through Mr. Hanish Bhasin had placed on record the security bond alongwith FDR This is a digitally signed order. The Order is downloaded from the DHC Server on 23/04/2026 at 12:44:26 bearing Term Deposit No.3350089183 dated 12.01.2024 for Rs.5,10,000/- issued in favour of Tulip Holidays/Respondent by Kotak Mahindra Bank, B- Block, Janakpuri Branch, New Delhi-110058 as security. 5. Vide order dated 26.02.2024 passed by my learned predecessor, the security bond was accepted and aforesaid FDR in original was returned to Mr. Hanish Bhasin, Partner of the respondent/firm after making necessary endorsement. 6. As sequeal to above, an amount of Rs.5,00,414/- (after deducting TDS of Rs. 6,158/-) had already been released to respondent by the Registrar (B&A). 7. In view of the order dated 17.03.2026 passed by the Hon’ble Court, let the sum of Rs.5,10,000/- deposited vide FDR dated 12.01.2024 be released in favour of the respondent by cancelling the endorsement on the FDR the original of which is already with the respondent.
