CORAM: HON'BLE MRS. JUSTICE SUDEEPTI SHARMA Present: Mr. Kehar Singh Hissowal, Advocate for the petitioner. Mr. Akshay Goel, Advocate for respondents. * * * * * SUDEEPTI SHARMA, J. The challenge in the present writ petition is to order/letter dated 31.07.2021 vide which the petitioner who was working as attendant in Working Women Hostel, Panjab University, Sector-14, Chandigarh, was relieved from duty.
Learned counsel for the petitioner inter alia contends that the petitioner was relieved from duty without affording any opportunity of being heard. He, therefore, prays that the present writ petition be allowed and impugned order/letter dated 31.07.2021 be set aside.
MOHD AYUB 2026.07.27 17:24 I attest to the accuracy and authenticity of this order/judgment.
CWP-15892-2021 (O&M) -2- Per contra, learned counsel for respondents argues on the line of written statement filed by the respondents and prays that the present petition be dismissed. I have heard learned counsel for the parties and perused the whole case file with their able assistance. It would be apposite to reproduce relevant portion of the written statement filed by respondent No.2.
“Preliminary Objections:-
1. That the instant writ petition is not maintainable against the relieving order dated 31.07.2021 whereby the petitioner was relieved from her duty in terms of letter dated 25.08.2020 vide which extension in the employment of the petitioner as an Attendant in the Working Women Hostel in the Panjab university on daily-wages was extended w.e.f. 04.08.2020 to 31.07.2021 with one day break on 03.08.2021. Thus, she was relieved on completion of her term on 31.07.2021. No statutory right is vested with the petitioner to claim continuity in service as an Attendant in the Hostel in the university on daily- wages. Further, the petitioner as an Attendant was required to perform her duty as per the monthly duty- chart/roster issued by the Warden of the Working Women Hostel but she refused and was not willing to perform the 'Night duty' as per the duty-roster and started remaining absent from her Night duty'. She involved herself in
arguments with the Warden and co-workers regarding the duty-roster, duty-shifts and adjustments of duties. She was counseled individually as well as by the Committee constituted time to time by the Authorities but she remained adamant and refused to follow the monthly duty-roster for performing her 'Night duty'.” MOHD AYUB 2026.07.27 17:24 I attest to the accuracy and authenticity of this order/judgment. CWP-15892-2021 (O&M) -3- A perusal of the reply along with Annexure R-1 to Annexure R-25 shows the conduct of the petitioner. And as per the same, the petitioner was never serious towards her duties. Along with the reply, respondents have placed on record letter dated 16.07.2021 as Annexure R-25, the same is reproduced as under:-
“To The Assistant Registrar, Estt. Branch-II Panjab University Chandigarh Respected Sir This is in reference to the extension of Daily Wage Attendant, Ms Anju Bala working in the Working Women Hostel. In this regards it is submitted that Smt. Anju Bala DW- Attendant has been assigned duty as per roster along with other attendants but she has always refused to perform her night duty as such. She proceeded on maternity leave w.e.f. 13.05.2019 to 28.10.2019 and after her re-joining on 29.10.2019, the office on humanitarian grounds (keeping in view two small children) allowed here to perform duties in day shift. The Vice Chancellor vide circular no- DSW/20/932-950 dated 05.02.2020 has ordered that all attendants will work for day-night as per duty roster. Hence, the duty roster was prepared accordingly but Smt. Anju Bala again refused to perform her duty as per the roster. Moreover, she has filed a civil writ petition in the Honourable High Court (letter no LC/21/468 dated 10.02.2021) regarding her inability to perform duties in night. Keeping in mind the safety and security of women residents as well as the requirements of WWH, we need a person who can perform in shifts according to the duty roster of the hostel. In the instant case, Smt. Anju Bala herself is not willing to perform her duties as per orders. MOHD AYUB 2026.07.27 17:24 I attest to the accuracy and authenticity of this order/judgment. CWP-15892-2021 (O&M) -4- Accordingly, her extension is not recommended further as the attendants in the hostel are required for day and night. (Dr.
Avneet Saini) Warden, Working Women Hostel Panjab University, Chandigarh” A perusal of the above further shows that even the period of petitioner as daily wage Attendant was not extended. In view of the same, the present writ petition is dismissed being devoid of any merit. Pending miscellaneous application(s), if any, stand disposed of. 27.07.2026 (SUDEEPTI SHARMA) Ayub/Saahil
