HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous (Petition) No.6720/2021 Chandan Kumar Tanwar S/o Shri Gorakh Ram, Aged About 60 Years, Resident Of Radhakishanpura Rto Road, Ward No. 51, Sikar, Raj. ----Petitioner Versus The State Of Rajasthan through Its Public Prosecutor. ----Respondent For Petitioner(s) : Mr. Bharat Saini Mr. Abhishek Saini For Respondent(s) : Mr. N.S. Dhakar, PP Mr. Gaurav Gupta, Asstt. GA JUSTICE ANOOP KUMAR DHAND Order 20/05/2026 1. By way of filing the instant criminal misc. petition, a limited prayer has been made for issuing directions to the Court of Special Judge, Prevention of Corruption Act, No.2 Jaipur Metropolitan to conclude the trial in Sessions Case No.101/2015 expeditiously within a fixed time period. 2. Learned counsel for the petitioner submits that the petitioner is facing trial for the offence under Section 7 of the Prevention of Corruption Act, 1988 since last more than 11 years and till date the proceedings are pending. Hence, appropriate directions be issued to the concerned Court to conclude the proceedings in a timely manner. 3. Heard and considered the submissions made at the Bar and perused the material available on record. (2 of 2) [CRLMP-6720/2021] 4. The relief sought for cannot be granted by this Court, as the Hon’ble Apex Court in the case of High Court Bar Association, Allahabad Vs. State of Uttar Pradesh & Ors. reported in (2024) 6 SCC 267 has deprecated the practice of constitutional Courts issuing directions to the subordinate Courts to conclude the trial in a fix time bound schedule. 5. But looking to the fact that the petitioner is facing trial before the Trial Court since last more than 11 years i.e. since 2015, this Court deems it just and proper to dispose of the instant criminal misc. petition with the expectation from the Trial Court to make all possible endeavours to conclude the trial expeditiously, as early as possible, by procuring the attendance of the witnesses by summoning them through the concerned Superintendent of Police. 6. With the aforesaid observations, the instant criminal misc. petition stands disposed of. All pending applications, if any, also stand disposed of. (ANOOP KUMAR DHAND),J 46/Karan
