By way of filing the instant criminal misc. petition, a challenge has been led to the impugned FIR No.993/2018 registered with Police Station Pratap Nagar, Jaipur City (East) for the offences under Sections 147, 148, 149, 323, 341, 427, 452, 302, 120-B IPC and Section 3(2)(v) of the SC/ST (Prevention of Atrocities) Act. 2. At the outset, learned Public Prosecutor, on the basis of factual report received from the Station House Officer, Police Station Pratap Nagar, Jaipur East, submits that after investigation the involvement of the petitioner-Shivraj Meena has not been found to be proved and the police has proposed final report. He further submits that under these circumstances, no cause of (2 of 2) [CRLMP-5685/2021] action survives with the petitioner to continue with this petition and the same has become infructuous. 3. Considering the above factual aspect of the matter, the instant criminal misc. petition is dismissed as having become infructuous. The stay application as well as all pending applications, if any, also stand dismissed. 4. However, the petitioner would be at liberty to move application for revival of this petition, in case, any grievance or cause of action still survives. 5.
