SEPTEMBER 17, 2026 WRIT PETITION NOS. 3510/2021, 275/2022 AND 220/2022 The Counsels for the petitioners jointly submit that the issue involved is covered by an order dated 16/4/2026 passed by the Division Bench of this Court in Writ Petition No. 7949/2022 [Kishor Damodhar Khobragade & Oths. Vs. The State of Maharashtra & 2026:BHC-NAG:12399-DB 4-WP-3510-2021 2 Oths.] with other connected matters. The Court considered the judgment passed in Writ Petition No. 3642/2021 as also Writ Petition Stamp No. 9543/2021. The Court further considered the Circular dated 29/2/2024 issued by the Government of Maharashtra, and granted liberty to the petitioner to move fresh representation before the concerned Chief Executive Officer (CEO). The Court directed the CEO to consider the representation in the light of the decisions taken in the Writ Petitions mentioned above as also the Circular dated 29/2/2024. Similar course could be adopted in the present petitions as well. 2] Accordingly, and in terms of the order dated 16/4/2026, we permit the petitioners to move fresh representation before the concerned CEO, who shall consider the same in the light of the decisions taken in the Writ Petitions mentioned above as also the Circular dated 29/2/2024. The decision shall be taken within four weeks from the date of receiving representation. If required, the CEO shall also taken decision in respect of payment to be released from the date of stoppage of increment till its restoration. 3] The petitions are disposed of in terms of above directions.
