Learned State counsel refers to para 3 of the status report dated 17.03.2025 filed by Assistant Commissioner of Police (North), Ludhiana, which reads thus: “ 3. That at the very outset, it is humbly submitted that in the present case FIR No.122 dated 03.06.2016, u/s 419, 420, 465, 467, 468, 471, 120-B IPC, P.S. Saleem Tabri, Ludhiana (Annexure P-8), Challan/Final Report u/s 173 Cr.P.C. has already been submitted on 14.10.2024 against three accused in their absence as they have been declared Proclaimed Persons vide order dated 30.08.2024 and now the said Challan/Final Report is pending in the court of Sh. Gurinder Pal Singh, Ld. JMIC, Ludhiana and is now fixed for 16.04.2025 for prosecution evidence as envisaged u/s 299 Cr.P.C. In fact there were total four accused in this case out of which one accused namely Harpal Singh was already arrested on 13.06.2018 and his Challan/Final Report u/s 173 Cr.P.C. was prepared as well but before submission of the Challan/Final Report before the Ld. Trial Court, the said accused Harpal Singh expired on 13.01.2019. However, the remaining three accused namely Harmeet Singh, Sunil Kumar and Bachan Singh are absconding and they have been declared Proclaimed Persons by the Ld. Magistrate vide order dated 30.08.2024 and in their absence, Challan/Final Report has been presented before the Ld.
