This writ petition has been filed for the grant of following substantive reliefs: - “i. That the impugned order dated 19.02.2020 (Annexure P-3) passed by respondent No.2, whereby the claim of the petitioner for compassionate appointment has been rejected may kindly be quashed and set aside being wrong and illegal. ii. That the respondent department may kindly be directed to appoint the petitioner on compassionate ground to the post of Helper/Clerk in the respondent department, in the interest of justice and fair play.” 2. Respondents have placed on record instructions dated 11.08. 2026. As per office instructions, the screening 1 Whether reporters of the local papers may be allowed to see the judgment? yes 2 committee on examining the case of the petitioner found him eligible for consideration under the Compassionate Employment Assistance Policy dated 07.03.2019. Vide office letter dated 04.08.2026, respondents have conveyed their decision to offer appointment to the petitioner as Junior Office Assistant (IT). Under the same office letter, petitioner has been directed to qualify the typing test as per terms and conditions of the policy dated 07.03.2019. 3. Learned counsel for the parties have invited attention to Clause 5(c) of the aforesaid Policy, according to which three chances are permissible within a maximum time span of 12 months to qualify the typing test. Learned counsel for the petitioner submitted that petitioner has availed first chance on 23.08.2026, result whereof is awaited. Learned counsel for the respondent has placed on record an affidavit in compliance to the directions issued on 18.08.2026 in this petition. Apology tendered in the said affidavit is accepted. 3 4. Taking note of the office instructions and the submission made by learned counsel for the parties, this petition is disposed of at this stage with liberty reserved to the petitioner to seek appropriate remedy in accordance with law at an appropriate state, in case necessity so arises in future.
