JUDGMENT : (Per Hon’ble Sri Justice D.Ramesh)
The present Civil Miscellaneous Appeal is filed by the husband aggrieved by the decree and order dated 12.03.2024 passed by the learned Principal Senior Civil Judge, Madanapalle, Chittoor District in H.M.O.P.No.94 of 2021 dated 12.03.2024. 2. The said H.M.O.P. was filed by the appellant herein under Section 13(1)(ib) and (v) of the Hindu Marriage Act, 1955 seeking dissolution of the marriage solemnized between the appellant-husband and the respondent-wife on 17.06.2018. Upon consideration of the matter on merits, the learned Principal Senior Civil Judge, Madanapalli, dismissed the said H.M.O.P.
3. During the pendency of the appeal, both the parties have filed a joint- memo of compromise containing the following terms:
i. That the appellant-husband agreed to pay an amount of Rs.10,00,000/- to the respondent- wife towards full and final settlement of her past, present and future maintenance and the said amount has been paid to her. ii. The appellant-husband deposited a sum of Rs.3,00,000/- in the form of a fixed deposit in the name of their daughter S.C.Karthika. iii. The respondent-wife is entitled to withdraw the interest accrued on the Fixed Deposit as guardian of the minor daughter, but she shall not withdraw the principal amount until the daughter attains majority. iv. The respondent-wife shall not be entitled to claim any past, present or future maintenance or alimony from the appellant-husband. v. The respondent-wife agreed for dissolution of the marriage and to co-operate in the disposal of C.M.A.No.413 of 2024. vi. The respondent-wife has withdrawn the D.V.C.No.20 of 2021 in view of the compromise. vii. The respondent-wife has also withdrawn complaint in C.C.No.100 of 2022 on the file of Additional Junior Civil Judge, Madanapalle. viii. The respondent-wife and the minor daughter shall not make any further claim against the appellant-husband towards maintenance, damages or property rights. 4. On 03.07.2026, both the parties produced their identity proofs and appeared before this Court. Today, they were identified by their respective counsel. Upon interaction, the respondent-wife stated that she has voluntarily entered into the compromise and received the amounts agreed upon under the compromise memo. 5. Recording the aforesaid submissions and the compromise entered into between the parties, the appeal is allowed. Consequently, the marriage solemnized between the appellant-husband and the respondent-wife on 17.06.2018 is dissolved with effect from today. There shall be no order as to costs.
As a sequel, all miscellaneous petitions, if any, pending in this appeal shall stand closed. ____________ D.RAMESH, J
