Virender Singh, Judge (oral) The present appeal has been filed by the appellant, under Section 299 of the Indian Succession Act 1925, read with Section 104 and Order 43 of the CPC, against the judgment dated 25.3.2021, passed in Probate Petition No. 1 of 2019, titled as, ‘Sudarshna Devi & anr. vs. General Public and others’, passed by the learned District Judge, Hamirpur, H.P. 2. During pendency of the present appeal, the matter has been settled between the parties. The terms and conditions of the compromise are reduced into writing and 2 placed on record, as Ext. PX. Statements of the parties have been record, according to which, they are bound by the terms and conditions of the compromise, Ext. PX. 3. In view of the compromise, having been taken place between the parties, the learned counsel for the appellant, under instructions, wants to withdraw the present appeal. Permission granted. 4. Consequently, the present appeal is dismissed as withdrawn, so also the pending application(s), if any. 5. The parties to the lis are bound by the terms and conditions of compromise, Ext.
