Nursing Course on account of non-issuance of No Objection Certificate by the respondent-State. Yes. 2 on 24.11.2021 for the grant of following substantive reliefs : - “i) That the respondent No 1 may kindly be directed to issue Essentiality Certificate/NOC to the Petitioner for starting M.Sc Nursing Course with 25 seats for the academic session 2021-22 as per the recommendations of the SDM Level Inspection Committee dated 23-07-2021 at Annexure P-11 colly; (ii) That respondent HPNRC may kindly be directed to grant the recognition to the petitioner college for running MSc course for the academic session 2021- 22 by conducting inspection of the petitioner college at the earliest i.e. before the admission process concludes; (iii) That AMRU respondent No 4 may also be directed to grant affiliation to the new MSc course of the petitioner college for the session 2021-22; (iv) That the petitioner may kindly be allowed to admit students in MSc Nursing course 2021-22 with 25 seats by participating in the ongoing online counselling process for admission in MSc course for academic session 2021-22.” 2. Pursuant to interim orders passed in this petition from time to time viz dated 04.12.2021, 24.08.2024 and 20.08.2025, pending issuance of No Objection Certificate, the respondents were directed to permit the petitioner-college to provisionally participate in the counselling for M.Sc. Nursing Course for different academic sessions that commenced during the interregnum, till date. Further directions were issued to reflect the name of the 3 petitioner in the list of colleges eligible for such counselling. Respondent No.4 i.e. Atal Medical & Research University was also directed to give provisional affiliation to the petitioner-College. Pursuant to these directions, students have been admitted in M.Sc. Nursing Course in different academic sessions and they have passed out from the college. 3. Learned Senior Counsel for the petitioner submits that during pendency of this writ petition, the respondents have now issued No Objection Certificate to the petitioner-College on 03.01.2026 for start of M.Sc. Nursing Course (Annexure P-25) subject to terms and conditions mentioned therein. A copy of the said letter has also been addressed to respondent No.3-Himachal Pradesh Nurses Registration Council. 4. Since the substantive relief prayed for by the petitioner has now been granted to it by the respondents, this writ petition, in the interest of justice, therefore, is disposed of with the order that provisional participation in the counselling for M.Sc. Nursing Course of the petitioner for different academic sessions, pursuant to the interim orders passed in this writ petition, shall be treated as final 4 and shall be accepted by the respondents as valid for all intents and purposes. The students admitted pursuant to the aforesaid orders and who have passed out from the petitioner institute, shall be registered with respondent No.3 in accordance with law, subject to fulfilment of other conditions, if any.
