Ajay Mohan Goel, Judge (Oral) By way of this petition, the petitioner has, inter alia, prayed for the following relief:- “i) That the respondents may be ordered to process the case of the petitioner for pension and other retiral benefits and the same may be ordered to be paid to the petitioner from the due date with all the benefits incidental thereof.” 2. Learned counsel for the petitioner though initially submitted that the respondents be directed to take the deemed date of appointment of the petitioner as the year 1991 for the purpose of grant of pension, but confronted with the query qua entitlement of an ex-serviceman to have his active military service 2 rendered counted for the purpose of seniority, learned counsel for the petitioner made an alternative prayer that respondents be directed to consider the case of the petitioner for grant of pension by treating his date of appointment as Forest Guard as 09.07.2007. 3. This Court is of the considered view that it would be in the interest of justice, in case, this petition is disposed of with the direction that qua his prayer for considering him for grant of pension with effect from the date of his engagement as a Forest Guard i.e., 09.07.2007, the petitioner may approach the Authority by way of a representation within two weeks from today and the Authority may pass appropriate order thereupon within a period of six weeks as from the date of the receipt thereof in light of the contents of the representation.
