Also heard Ms. U. Das, learned State Counsel. The present challenge is against an order of suspension of PDS license. The learned counsel for the petitioner has however informed that from the affidavit-in-opposition filed by the respondent no. 3, it transpires that the license itself has been cancelled. Ms. Das, the learned State Counsel has submitted that such cancellation was done way back in the year 2022 and no action till now has been taken by the petitioner to challenge the same. Shri Hoque, the learned counsel for the petitioner has responded that no information was ever received by the petitioner and it is only from the affidavit- in-opposition filed on 05.06.2026 that such information came to light. He accordingly submits that he may be allowed to withdraw this writ petition with a liberty to challenge the cancellation order. Considering the facts and circumstances, the aforesaid prayer is granted. Accordingly, the writ petition is dismissed on withdrawal with liberty to challenge the cancellation order, if so advised.
