Also heard Mr. R K Talukdar, Learned Standing Counsel, Accountant General (A&E), Assam and Ms. M Das, Learned Standing Counsel, PWD, Assam. Mr. R K Talukdar, Learned Standing Counsel, Accountant General (A&E), Assam, has submitted that FPPO No. 912314341106 has Page No.# 3/5 been finalized, authorizing to the Petitioner family pension, in respect of the services rendered by her deceased husband Late Abdul Kadir. He submits that the FPPO would be issued to the Treasury Officer, with a copy to the Petitioner, within a period of 1 (One) week. Mr. K R Patgiri, Learned Counsel for the Petitioner submits that the FPPO having been finalized and the same now being undertaken to be issued to the Petitioner, within a period of 1 (One) week, the grievance, with regard to the non-sanction of family pension to the Petitioner has been redressed. Mr. K R Patgiri, Learned Counsel for the Petitioner, however, submits that the Petitioner has not been authorized a DCRG, in the matter and no GPO has been issued to the Petitioner. He submits that the GPO has also not been issued to the first wife of the Petitioner, who had earlier submitted applications. He submits that the present Writ Petition be closed, with liberty to the Petitioner to approach the Respondent authorities, praying for grant of gratuity to the Petitioner, in respect of the services, rendered by her deceased husband. Page No.# 4/5 In view of the above developments taking place in the matter and considering the submissions made by the Learned Counsel for the Parties, this Court directs the Accountant General (A&E), Assam, to issue the FPPO noticed, hereinabove, which is already finalized to the Petitioner and other concerned authorities, within a period of 1 (One) week from today. Further, the Court grants liberty to the Petitioner to approach the Departmental authorities i.e. authorities in the PWD, Assam, praying for being authorized gratuity and other Pensionary benefits, as may be admissible for the services, rendered by her deceased husband. In the event of receipt of applications by the authorities of PWD, Assam, the same be given its due consideration and disposed of, by way of passing a speaking order, within a period of 3 (Three) weeks from date of receipt of such representation, along with a certified copy of this order. With the above observations and directions, the present Writ Petition stands closed.
