Also heard Mr. G. Goswami, learned Standing Counsel, N.F. Railway. 2. In deference to the earlier order dated 09.02.2026, Mr. Mrinmoy Kumar Bhattacharjee, Retired District & Session Judge of Assam was appointed to act as an arbitrator for the petitioner and Mr. Bani Kanta Das, Advocate and Former Chief Engineer and Secretary to the Government of Assam, PWD was appointed to act as arbitrator for the respondents. Accordingly, the copies of the order were communicated and the order was made subject to furnishing of the statement of declaration by the respective arbitrators. By communications dated 16.02.2026 & 27.02.2026, the respective arbitrators namely Sri. Mrinmoy Kumar Bhattacharjee, Retired District & Session Judge of Assam, and Sri. Bani Kanta Das, Advocate and Former Chief Engineer and Secretary to the Government of Assam, PWD Department have furnished their written declaration expressing no difficulty to act as an arbitrator, if appointed. 3. Consequently, in view of the written declaration furnished the appointment of Sri. Mrinmoy Kumar Bhattacharjee, Retired District & Session Judge of Assam, and Sri. Bani Kanta Das, Advocate and Former Chief Engineer and Secretary to the Government of Assam, PWD Department are hereby confirmed to act as arbitrators for the petitioner and the respondents respectively.
