This Public Interest Litigation was initiated by one Dr. Abdul Rouf Malik claiming to be the representative of Inhabitants of Gogji Bagh, Srinagar, in which he had raised concern about the erection and re-erection of residential and commercial buildings/complexes in the area in gross violation of Building Bye-laws. 02. Learned counsel for the petitioner fairly submits that pursuant to the intervention made by this Court, the persons who were responsible for raising residential/commercial buildings allegedly in violation of Building Bye-laws were put on notice by the Srinagar Municipal Corporation. He submits that the aggrieved persons availed the appropriate remedies and approached the J&K Special Tribunal. The matter is now pending consideration before the learned Single Judge of this Court at the instance of Srinagar Municipal Corporation. 03. Since the primary grievance of the petitioners highlighted in the PIL is being taken care of by this Court in a separate proceedings, and, therefore, we do not wish to continue with this PIL. However, we cannot lose sight of the fact that during the course of proceedings in this PIL, it came to the notice of this Court that a particular member of the J&K Special Tribunal had passed several orders, about 65 in number in a row, compounding the major violations. The fact finding inquiry by the Registrar Vigilance was directed by this Court vide order dated 20.11.2020 passed in CCP(D) No. 15/2020. 04. The Registrar Vigilance has submitted its report with his conclusion that all the 65 matters were compounded by the then Member of the Tribunal for extraneous consideration, in that, the major violations were permitted to be compounded in violation of law. The detailed report of Registrar Vigilance dated 05.04.2021, is on record. 05. In view of the aforesaid while closing this PIL, we direct the Registry of this Court to forward the report of Registrar Vigilance dated 05.04.2021 to the Chief Secretary of UT of Jammu and Kashmir for taking appropriate legal action against the erring public servant who is prima facie found guilty of violating the law and compounding the major violations for extraneous considerations. 06.
