Petitioner, through the medium of this petition filed under Section 482 of the Cr.P.C., seeks quashment of complaint No. 542/Cr Misc dated 29.08.2019, sub-judice before the court of learned Judicial Magistrate (Sub-Registrar), Jammu so far as it pertains to the petitioner and further quashment of all ancillary proceedings initiated by the respondent No. 2 against the petitioner. The petitioner also seeks quashment of FIR No. 2/2020 lodged with Police Station, Women Cell Gandhi Nagar, Jammu. Serial No. 26 Regular List CRM(M) No. 256/2020 02. Learned counsel for the petitioner submits that the petitioner as brother-in-law, had been implicated by the respondent No. 1/complainant-Anju Bala alongwith the other relatives, despite the fact that he had nothing to do with the family, as he was living separately. He has also produced a copy of the order dated 06.09.2024 passed in CRM(M) No. 456/2020 titled–“Harbans Lal & Ors. vs Anju Bala & Ors.”, whereby the petition filed by the husband and other in-laws of the complainant had been allowed and the impugned complaint and the FIR have been quashed. 03. There is no representation on behalf of the respondent No. 1/complainant. It may be because of the compromise reached by her with her in-laws, which has been indicated in the order dated 06.09.2024 passed in CRM(M) No. 456/2020. 04. In view of the reasons assigned in CRM(M) No. 456/2020, this petition wherein the same complaint and FIR have been impugned is also allowed and as a result, the impugned complaint and the FIR are hereby quashed, qua the petitioner as well. 05. Petition is, accordingly, disposed of, as allowed along with connected application(s).
