Appearance: Mr. Gaurab Kumar Das, Adv. …for the applicant The Court:- This is an application for grant of probate of the last Will and Testament of the deceased Sri Subodh Chandra Sen. The deceased Sri Subodh Chandra Sen had last place of residence at No. P-274, C.I.T. Road (Maniktala Main Road), P.S.:- Phoolbagan, Kolkata-700054. He was a Hindu governed by Dayabhaga School of Hindu Law. He breathed her last on 15th May, 2019 at her place of residence. Prior to his death, he executed his last Will and Testament dated 16th July, 2018 whereunder the petitioner was appointed as the Executor of the Will. On death of the Testator, the petitioner filed this application for grant of probate of the said Will. 2 Once the probate proceeding had been instituted, citations were issued. No caveat was lodged, as a result of which the proceeding became non- contentious cause. One of the attesting witnesses deposed that the Testator executed the Will in presence of the attesting witnesses and the attesting witnesses also put their signature in the Will in presence of the Testator. It was also deposed that the Testator was physically fit and mentally alert at the time of execution of the Will. On appreciation of the evidence this Court is of the opinion that due execution of the Will has been proved. Let probate be granted to the said last Will and Testament of the deceased dated 16th July, 2018. Inventory and accounts shall be filed within six months from the date of grant of probate.
