The Present Petition is not against any particular order but against the inaction of the Respondent authority, by which Respondents authorities are not considering the case of the petitioners for payment of difference amount arising out of wrong valuation of Petitioner's land during land acquisition. 2. The petitioners have filed this Writ Petition seeking following reliefs:- “a) That, this Hon'ble Court may kindly be pleased to call the entire records from the respondents. b) That, this Hon'ble Court may kindly be pleased to issue appropriate writ by directing the Respondent to make the reference to appropriate Authority in light of the representation. c) That the Respondents authorities may kindly be directed to properly evaluate the land of the petitioners acquired by them and direct the Respondent authority to provide adequate compensation to the petitioners according to the documents on reports. d) Any other relief, which this Hon'ble Court deems fit and proper, may also kindly be granted to the petitioners, in the interest of justice.” 3. Learned counsel for the petitioners submits that the lands belonging to the petitioners have been acquired; however, 4 adequate compensation has not been awarded to them. It is further submitted that the petitioners had moved an application before the concerned Collector Raigarh seeking reference for enhancement of compensation, and such reference application was submitted on 03.01.2013, but the same has not been decided till date. It is therefore prayed that the concerned Collector, Raigarh, be directed to consider and decide the said application of the petitioners in accordance with law within a time-bound manner. 4. Learned counsel for the respondents submits that he has no objection if this Court directs the concerned Collector Raigarh to consider and decide the application for reference filed by the petitioners on 03.01.2013, which, according to the petitioners, is still pending consideration. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Upon perusal of the record, it appears that the petitioners have submitted an application dated 03.01.2013, before the concerned Collector, Raigarh seeking reference for enhancement of compensation against the award which, according to them, was passed on 12.05.2008 and the same requires reconsideration. 7. Since the said application is stated to be pending consideration for a considerable period, the concerned Collector, Raigarh, is 5 directed to examine the same and take an appropriate decision strictly in accordance with law. The competent authority shall first verify the application and thereafter decide it on its own merits after affording due opportunity to the petitioners, if required. The exercise shall be completed expeditiously, preferably within a period of 45 days from the date of receipt of a certified copy of this order. 8. It is made clear that this Court has not expressed any opinion on the merits of the petitioners’ claim for enhancement of compensation and all issues are left open for consideration by the competent authority. 9.
